STAY OF CLINTON YOUNG'S EXECUTION
(originally scheduled for October 26th)
Further to the recent application for a writ of habeas corpus "seeking relief from a judgement of death, the
execution of Clinton Lee Young (scheduled for October 26, 2017) is stayed. According to the Federal Public Defender, CDCA:
The Texas Court of Criminal Appeals today issued
an Order remanding Clint Young’s case to the trial court to resolve the due process violation when false and misleading testimony was introduced at his trial. The execution date of October 26, 2017 is stayed. The stay was issued following a last minute Application for Writ of Habeas Corpus filed by the Federal Public Defender’s Office for the Central District of California.
“Applicant has only met the requirements of Article 11.071 § 5 regarding his first allegation, in which he contends that false or misleading testimony was introduced at trial . . . Thus, we find that [Clinton] has met the requirements of Article 11.071 § 5(a)(1) for his first allegation, and it is remanded to the trial court for resolution. Applicant’s motion to stay his execution is granted.

Who is Clinton Lee Young?
Clinton Lee Young is 31 years old. He has interest in philosophy , sociology , science , history , politics , world religions and meeting new people. As a child, Clinton was diagnosed at an early age with Attention Deficit Hyperactivity Disorder (ADHD) - a biological and chemical malfunction in an immature brain for which he did not receive adequate treatment. As a teen ager, M. Young experienced failure - at home, in school, with relationships. Today, Clinton Lee Young no longer suffers from ADHD. Although he did mistakes, he maintains his wrongful conviction in the murder that led him to death row. He would like to have a chance to rebuild his life. He says:
Yes I did have a juvenile record (...).
The listed crimes all took place when I was fourteen years old.
It was a truly turbulent period in my life full of internal conflict and a chaotic relationship with my parents. I ran away from home numerous times. Even swimming across a lake that was almost a mile wide at one point. (...) I was never convicted of these crimes, as everything was resolved in juvenile court. They are no longer on my record due to my current age. This means that if I am cleared of these charges that resulted in me getting sent to death row, then I would have a clean record, I would then be able to accomplish any goal that I had a desire to achieve. Case summary
Clinton Lee Young was convicted of murdering two men, Doyle Douglas, 41, of Ore City and Samuel Petrey, 52, of Eastland for the use of their vehicles in November 2001. Of the four people involved, Clinton Lee Young was the youngest one (18 years and 4 months). He was the only one sent to death row. Whilst there is no discussion about the fact that he participated to the event that led to the double murder, he has always maintained that he did not shoot any of the victims. Had he been 4 months younger, he would not have been sent to death row.
The State’s case against Clinton Young relied primarily on the testimony of the three other involved men. The State maintained that Clinton was the driving force in the murders and kidnapping, and that the other’s involvement was the result of duress caused by Clinton Young.
Two co-defendants were held on murder charges and later pled guilty to lesser charges. The fourth involved man, who had by his own volition directed the police to one of the bodies, was never charged.
October 2017 Update from the Clinton Young Foundation:
"Recently, Clinton's lawyers requested the gloves that were found on the second murder scene to be tested again in order to see if there was gunshot residue on them. This could indicate that they were worn by the shooter.
The results came in a few weeks ago. It turns out that the gloves are, in fact, saturated with gunshot residue, including between the fingers where gunshot residue would land if the gloves were worn during the shooting of a gun. David Page admitted to wearing a pair of gloves that were found at the scene. Earlier, his DNA - and not Clinton's - was found inside the gloves. Clinton Young's attorneys have moved the Texas trial court to withdraw the execution warrant based on these results combined with David Page's other admissions: they insist that this new evidence demonstrates that David Page shot Mr. Petrey."

What his support committee says
After reviewing the court documents, his support committee believes in Clinton's innocence, based on various evidence that can be downloaded below. This includes:
I) There was no physical evidence linking Clinton Lee Young to the crimes. In particular, a ballistic analysis done after the trial has determined that Clinton could have in no way committed either murder. Here is the document showing the ballistic report (download below). It states:
It was the trial testimony of Mark Ray that Clinton Young fired these two shots (first) into the victim, inside the automobile, using the Colt Huntsman .22LR pistol before Mark Ray (later) fired his one shot into the back of the head of the victim.(...). It is [further] the opinion of this examiner that the profound inconsistencies discovered between the physical evidence associated with this shooting incident and the sworn testimony at trial by Mark Ray should cast doubt on the truthfulness of the account(s) rendered by Mark Ray in the matter of this case.
ii) The only evidence against him was the false testimonies of his 3 co-defendants. Evidence shows that they were given secret deals in exchange for false testimony against Clinton came out after his trial (See below Mark Ray's testimony, Page and Young's lawyers affidavits)
In Clinton Lee Young's habeas Corpus petition, his lawyer says:
Unbeknownst to the defense, David Page, the only person who was with Young at the time of both the Doyle Douglas and Samuel Petrey's homicides, and mark Ray, the individual who fired the final (and perhaps fatal) shot into Douglas's head the night of the crimes, secretly negotiated with the State for reduced charges and sentences in exchange for their testimony against M. Young. Not only did the State fail to turn over this material, exculpatory evidence, the State knowingly presented testimony at a pre-trial hearing that no such deals existed. The withholding of the evidence regarding Pages' and Ray's plea negotiations, and the knowing presentation of perjured testimony, mandate that M.Young's conviction be overturned. (...)
In addition, Page failed a polygraph test, pointing to the hypothesis that he may have been the killer. The analyst concludes: "Deception is indicated".

iii) Various jurors have stated (see affidavits below) that had they known of the ballistics evidence and the secret plea deals, it certainly would have raised questions about the involvement of M. Page in the shooting of M.Petrey, and they'd have wanted to have known that information as jurors

that M. Young was made the scapegoat for crimes that the others were also involved in.

I’ve been knowing Clinton for the past four years. He’s a genuine sweet and loving man, and I’m lucky to be his friend. Not only that he has helped numerous friends to get through very tough times and trauma. He has a special interest in helping children and has donated to an organization called Smile Train as well as helped numerous others. Clinton has one of the biggest hearts of any human He has lived a very hard life but despite that he smiles and worries more about others even then himself.
We desperately need help for Clinton now. We do not want to wait until Clinton is given an execution date and it is too late. Clinton needs money to hire a powerful and efficient private investigator.
