Who is Gerald Marshall?
Gerald Marshall is a foster child from drugs addicted parents. He has 3 siblings, all of whom have been placed in a foster home as children. At 18, the state of Texas wouldn’t pay for him any longer. Gerald Marshall ended up on the streets for a while. He would just ride the metro all day and night until the bus stopped. Then he would walk down town Houston until the busses started back up and do it all over again. He then started doing things out of character and was arrested for capital murder. He says:
It is important to understand I am not trying to use my childhood as an excuse as to why I am on Texas death row. While I understand it is a major contributing factor. I am more hopeful that my situation will expose the fact the prisons in America are filled with foster children. A report showed that 69 percent of prisoners in California and Massachusetts were foster children in America. Also disturbing is the fact that 50 percent of homeless youth on the street are runaways from foster care. As I have learned these statistics and reflected on how I was neglected as a child, I understand why I made the bad decisions I made, and I hope to bring this system of putting foster children from this foster care in jail to the public's attention.

Case summary
In 2003, in Harris County, Texas, Gerald Marshall and 3 co-defendants entered a What-a-burger to commit a robbery.
During the course of the robbery a white male employee was shot in the head resulting in his death. Gerald Marshall was convicted to death for SHOOTING and KILLING Christopher Dean. After thoroughly examining the trial transcripts and other legal documents, the European Association for Human Rights has found that there are several things that show Marshall did definitely not kill Dean. Gerald sincerely declares his innocence of murder. The existing records, documents and trial transcripts suggest that there was no hard evidence for his conviction and that Gerald wasn't the shooter and that he wasn't even inside the restaurant. Witnesses’ statements were altered and spontaneously revoked and the court appointed attorney didn’t investigate important evidence for use in the trial. Read more

What Gerald Marshall says
Since I was arrested I have not been able to obtain the proper representation to prove my role in the crime and that I am innocent of shooting Christopher Dean.
Mostly my attorneys didn’t investigate my innocence. So, for instance, my trial attorneys never interviewed an important witness who can help prove I was not in the Whataburger Restaurant when Christopher Dean was killed and thus provide evidence that I am innocent of murder.
But there is other evidence that can be put forth that would help establish my innocence.

I believe if my trial attorney would have done the basic of investigating my case, he would have listened to the tape Meyer made and would have also been able to discover that Ronald Worthy admitted to being in the Whataburger Restaurant the morning of the murder. That would make Worthy the likely killer, not me. To date this was never properly presented to a jury or any judge. And I am alone, locked up and unable to have access to the records, except when my friends send them to me.
There is other evidence that can be found to help prove that I did not kill Christopher Dean. In the future, I hope to be able to present that evidence.
